This document is the property of GERMITEC France. All rights reserved. This publication and the contents of the platform may not be reproduced or transmitted, in whole or in part, in any form whatsoever.

PREAMBLE: LEGAL NOTICE/ACCEPTANCE

GERMITEC France, whose registered office is located at 19 rue Vauban 33000 Bordeaux, France (hereinafter referred to as "GERMITEC" or "we"), publishes the online training platform "Germitec" accessible from the following URL: https://germitec.riseup.ai (hereinafter referred to as the "Platform" or the "Site").

The services offered on the Platform are provided "as is" and are subject to acceptance of these general terms and conditions of use (hereinafter referred to as the "General Terms of Use" or "GTU").

DESTINATION AND CHARACTERISTICS OF THE TRAINING PLATFORM

The purpose of this e-learning Platform is to offer its users e-learning modules that include (hereinafter referred to as "User(s)" or "You") online training modules (e-learning) that include demonstrations, video sequences or interactive exercises on the GERMITEC Platform.

All the content of the Platform that can be consulted by Users and in particular the modules training modules mentioned above will hereinafter be referred to as the "Services".

GERMITEC offers on the Platform various contents protected by intellectual property rights or image rights that Users must scrupulously respect.

GERMITEC does not grant any right of reproduction, representation, modification, or other right of distribution to the Users regarding the contents appearing on the Platform.

Any unauthorized use made of such content by Users, or any other person would constitute infringement and therefore liable to civil or criminal proceedings.

GERMITEC does not guarantee the durability or performance of the Services accessible on the Platform.

GERMITEC cannot guarantee that the training courses offered will be properly assimilated and followed by the users. The effectiveness of the training courses and the completion rates of the training modules are not the responsibility of GERMITEC. However, to be certified and authorized to demonstrate, install, maintain, and train end-users, quizzes and evaluations must be passed with minimum of scores to generate certificates of training.

You acknowledge that you are using the Services offered to you "as is", with full knowledge of the facts.

Each User is, of course, solely responsible for his or her computer equipment, data, and software as well as the network connection allowing him/her to have access to the Platform.

GERMITEC does not guarantee that its Services are free of bugs or other malfunctions, a programming error or technical programming or technical incident being always possible.

GERMITEC cannot be held responsible for the temporary or permanent impossibility for the User to access all or part of the Services. RISE UP Licence ensures a online hotline of 24 hours in case of bugs or malfunctions.

REGISTRATION AND ACCESS TO THE PLATFORM

The User who wishes to have access to the GERMITEC training platform (hereinafter referred to as the Platform or the Site) must first identify himself/herself from the home page of the GERMITEC training platform from the registration email he/she received.

After logging in, the User can access the Platform.

The right to access the Platform is individual, exclusive, non-transferable, and non-assignable.

USER IDENTIFICATION INFORMATION

The data and particularly mandatory personal data provided by the User when registering for the Platform under the conditions referred here are as follows: company name, his/her surname, first name, email address phone number and pictures

All this data and information will hereinafter be referred to as the "Personal Data" and constitute the User's "Profile" which the User may freely consult and modify on the Platform.

The password provided by email, can be changed by the User at any time on the Platform.

Each User is responsible for the creation, conservation and use of his password which are strictly personal to him and therefore cannot be shared with third parties.

He must ensure their conservation, confidentiality, and secrecy.

Any use of the Platform by means of these identifier and password is deemed to have been made by the User himself.

If a User feels that his/her login and password have been usurped by a third party, he/she must immediately inform GERMITEC at the following email address: support@germitec.com.

TERMINATION OF THE USER'S REGISTRATION

The User may at any time request to unsubscribe and close his Account on the Platform: to do so, he/she should send an email to the following email address: support@germitec.com.

Confirmation of the unsubscription will be made within 48 hours of the request.

GERMITEC may at any time terminate the User's Account on the Platform by operation of law and without further formality in the event of a breach of these General Terms and Conditions of Use and in the event of a presumption of infringement of the law.

PERSONAL DATA COLLECTED

APPLICABLE REGULATIONS

GERMITEC is required to comply with the French and European legislation and regulations in force - in particular the General Data Protection Regulation n°2016/679 (RGPD) and the national provisions relating to data processing, files, and freedoms - or as they may be amended in the future - relating to protection of personal data (hereinafter the "Applicable Regulations").

PERSONAL DATA COLLECTED

GERMITEC collects and processes the Personal Data of the Users who connect on the Platform as well as the names of the courses consulted by the User, the time spent on the Platform by the User, the scores obtained by the User in case of answers to quizzes (hereinafter the "Data").
The User's personal data collected as part of the User's registration to the Platform and the use of the same are mandatory for the processing and management of the operation in question and for its computer processing carried out under the responsibility of GERMITEC.

GERMITEC France, may use the User's personal data collected and processed for the following purposes:

identifying Users in order to create an Account for them,
to allow Users to access the Services when they connect to the Platform,
to ensure the proper functioning of the Platform and the Services,
to inform Users of new features of the Platform,
inform the User of his progress in the training courses followed,
to carry out satisfaction surveys relating to the use of the Platform and the Services,
carry out anonymous and general statistics relating to the use of the Platform

This data is intended for GERMITEC, the data controller within the meaning of the Regulations
Applicable in the context of the purposes mentioned above, as well as to GERMITEC's technical service providers, for the purposes of the proper functioning of the Platform.

GERMITEC undertakes not to communicate or transfer to any other third party the Personal Data communicated by Users without their prior authorization unless it is obliged to do so by legal provisions or by court order. ARPEGE undertakes to make its best efforts to protect the Personal Data provided to it by Users, to prevent such data from being distorted, damaged or data are not distorted, damaged, or communicated to unauthorized third parties.

The personal nominative and non-nominative data relating to Users, collected through the Platform, and any future information, are only intended for exclusive use by GERMITEC in the context of the implementation of the Services offered to Users on the Platform, and are not to third parties, other than the technical service providers in charge of managing the Platform, who are the Platform, who are required to respect the confidentiality of the information and to use it only for the specific operation for which they are required to intervene. These personal data are kept for the duration of the training path and for a maximum of two years after the termination of the contract. The user may request the deletion of his/her account and the personal data associated with it; the data will be destroyed within two months of the request.

USERS' RIGHTS

In accordance with the Applicable Regulations, each User whose personal data is collected has the right to access, rectify, delete, to limit the processing and the right to object, on legitimate grounds, to information concerning them.

Each User benefits from the right to decide on the fate of their personal data post-mortem.

In cases where Users feel that their rights are not respected, they have the right to lodge a complaint to the “National Commission National de l'Informatique et des Libertés” (CNIL) in France.

GERMITEC declines all responsibility for the use of third-party websites to which access may be given via the Platform.

As soon as you are redirected to a third-party website, these Terms of Use cease to apply; only the terms of use of the site you are accessing then apply.

If you access via the Platform to illicit or harmful third-party sites in any way, please notify us immediately so that we can remove the link to the offending site without delay. Similarly, if any content or activity appears to you to be abnormal or illegal.

RESPECT FOR THE PROPERTY RIGHTS OF GERMITEC AND THIRD PARTIES

All content (photos, texts, videos, sounds, etc...) that can be consulted on the Platform are and remain, the exclusive property of GERMITEC and/or its partners and/or third parties.
You are therefore under no circumstances authorized to reproduce, modify, represent or market this content in any way whatsoever.

UPDATE OF THE GENERAL TERMS OF USE

GERMITEC reserves the right to modify and update at any time access to the Platform, as well as the present General Terms of Use.

GERMITEC will endeavor to inform Users of such changes.

These modifications and updates are binding on Users, who must consequently refer to regularly to this section to check the current General Terms of Use. The Users undertake to take note of all new versions of the General Terms and Conditions of Use of the Platform and to respect them.
